Welcome to My Beauty Pantry. These Terms of Service ("Terms") constitute a binding legal agreement between you ("you" or "User") and My Beauty Pantry ("we," "us," or "our") regarding your access and use of our website, services, and any related features, applications, platforms, or tools (collectively, the "Services").
By using the Services, you agree to comply with these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
1. Eligibility & Account Responsibilities
You must be of the legal age of majority in your jurisdiction to use the Services or have obtained verifiable consent from a parent or guardian. When you create an account or use the Services, you represent that all provided information is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and accept full responsibility for any and all activities that occur under your account. You agree not to sell, transfer, or assign your access credentials without prior written consent.
2. Product Presentation & Availability
While we make every effort to ensure product information, including visuals, descriptions, pricing, and ingredients, is accurate and current, actual product packaging and materials may differ. Variations may occur due to lighting, device settings, and manufacturing batches. We reserve the right to modify or discontinue any product or service at any time without notice. All product offerings are subject to availability, and we may impose limits on quantity per order, household, or geographic region at our sole discretion.
3. Orders, Acceptance & Fulfillment
Your submission of an order through our platform constitutes an offer to purchase under these Terms. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product unavailability, pricing errors, payment processing issues, or potential fraud. No order shall be deemed accepted until it has been processed and confirmed by us in writing (including via email). Modifications or cancellations post-confirmation may not be accommodated.
By placing an order, you confirm that your purchase is for personal or household use only and not for commercial resale or distribution.
4. Pricing, Taxes & Payment
All prices are shown in Australian dollars (AUD) and include GST. Shipping charges, where applicable, are calculated and shown at checkout before you pay. Prices are subject to change without notice. Promotions or discounts may be limited in scope or duration and are subject to applicable terms.
You agree to provide valid, complete, and up-to-date billing and contact details. By submitting payment information, you authorize us to charge your payment method for the full order total. We may cancel or delay fulfillment if the payment is unsuccessful or flagged for potential fraud.
5. Shipping, Delivery & Risk of Loss
We currently ship within Australia only. Shipping estimates are provided as guidelines and are not guaranteed. Delays caused by carriers or other external circumstances are beyond our control. Please see our Shipping Policy for more details. If your order arrives damaged or is lost in transit, please contact us and we will work with you and the carrier to resolve it.
6. Returns & Refunds
We accept returns for eligible items in accordance with our Refund Policy. Change-of-mind returns must be unused, unopened and in their original packaging. Refunds, if approved, will be issued to the original method of payment within a reasonable timeframe, subject to processing timelines of financial institutions. This does not affect your rights under the Australian Consumer Law if a product is faulty or not as described.
7. Ownership & Intellectual Property
All content made available through the Services—including but not limited to text, images, product visuals, brand elements, and layouts—is the proprietary property of My Beauty Pantry or its licensors. You are granted a limited, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial purposes only. Unauthorized use, reproduction, or distribution of any part of the Services is strictly prohibited.
8. Third-Party Integrations & Links
Our Services may include tools, services, or links provided by third parties. We are not responsible for their content, accuracy, privacy practices, or any consequences of your interaction. Accessing such links is at your own risk and governed by the respective third-party's terms and policies.
9. Privacy & Data Use
Your submission of personal data through the Services is governed by our Privacy Policy. By using the Services, you consent to the collection, use, transfer, and storage of your data as outlined therein. Our Services are hosted by Shopify, which may store data in jurisdictions other than your own.
10. Feedback & Content Submission
If you voluntarily submit feedback, reviews, suggestions, or similar content, you grant us an irrevocable, royalty-free, worldwide license to use, modify, publish, and distribute such content for any lawful purpose without obligation or compensation. You represent that such content is original and non-infringing.
11. Restrictions & Misuse
You may not use the Services for any illegal, unethical, or unauthorized purpose. Prohibited activities include, but are not limited to: violating intellectual property rights, disrupting Service functionality, harvesting user data, transmitting harmful code, impersonation, and spamming. We reserve the right to terminate your access for any breach of these Terms.
12. Disclaimers
To the extent permitted by law, the Services are provided "as is" and "as available", and we do not guarantee uninterrupted or error-free access to the Services. Our products come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these Terms limits those guarantees.
13. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of profits, revenue, or data, arising from or related to your use of the Services. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to replacing or repairing the goods, supplying equivalent goods, or refunding the price paid.
14. Indemnification
You agree to indemnify and hold harmless My Beauty Pantry, its affiliates, officers, employees, and partners against any claims, losses, or liabilities arising out of your breach of these Terms or misuse of the Services.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any legal disputes shall be submitted to the exclusive jurisdiction of the courts of New South Wales.
16. Modifications
We may update these Terms from time to time. Changes are effective upon posting, and the effective date above will be updated. Continued use of the Services after any modifications constitutes acceptance of the revised Terms.
